Stop Child Executions was informed that in preparation for execution, Saeed Jazee was transferred to solitary confinement and he is in danger of execution as early as tomorrow morning.
Two other Iranian children: Behnoud Shojaee and Mohammad Fadaee are scheduled to be executed at 5 am, Wednesday morning in Tehran.

Mohammad writes: “I am a 21 year old young man, who was only 16 when entered prison. Like any other teenagers, still living my childhood dreams. Fear of university Entrance Exam had not entered my life yet. A sweet anxiety that I have envied since.”
The letter continues by describing his imprisonment. How when he voluntarily went to the police station to report a fight of which he was a witness and his attempt to break up the fight, but he was arrested instead.
He continues: “ times I had spent in Agaahi (which is an Intelligence prison), were the worse days of my life. I had
nightmares every ngiht. I was beaten and flogged repeatedly. Those times when they hanged me from the ceiling left me with no hope in living. Any time, any person passing by, would kick me, torture me, to the point that one night I said to them, enough is enough, write whatever you want, I’ll sign. Half an hour later, they put a paper in front of me. Without knowledge of what is in the letter, they forced me to finger print it (a term used as a signature), God is my witness, I did not know what I had signed. Later I found out that it was a confession to murder. Afterwards, my family hired two lawyers whom unfortunately turned out to be crooks”
“They asked me to write my will the night I was going to be hanged. I didn’t know what a “will” was. When they put the noose around my neck, I closed my eyes and asked my God for help. Just few seconds before hanging, it was halted, because they found out that my lawyers were fake. When I was coming down from the stairs, once again I saw hope and felt I am going back to the school again!”
Mohammad writes in another paragraph of his letter: “Once again, I’m awaiting death sentence, I’m no longer afraid of death. I have lived with it for years now. It’s been years that its nightmare has frightened me. It has been years since they have hanged my dreams before hanging me. There is not a day that goes by that I don’t tell my mother, this may be my last phone call, and there is not a day that my mother does not cry.”
“I still can not believe that I will be dead in a few days. I can’t believe that I have to go up the same steps for them to place the rope around my neck. Almighty God has been my only hope and companion, to whom I pray and talk with”.
In last paragraph, Mohammad asks all those concern, to take actions (for him and many other teenagers with similar fate).
He ends and signs his letter by “ with hope for life”
Mohammad Fadaei is one of the minor offenders who is scheduled to be executed on June 11
Behnoud Shojaee is scheduled to be executed this Wednesday .
Although there is less than 48 hours left to Behoud’s execution but in violation of Iran’s laws his attorney has not be been formally informed yet.

سه پسر نوجوان که در سنين زير 18 سال مرتکب قتل شده بودند در ليست اعداميان اجراي احکام دادسراي جنايي تهران قرار گرفتند.به گزارش خبرنگار ما نام بهنود شجاعي، سعيد جزي و محمد فدايي که هر سه در نزاع دسته جمعي و زماني که زير 18 سال سن داشتند مرتکب قتل و در محاکمه هايي جداگانه به قصاص محکوم شده بودند اکنون در فهرست اعداميان چهارشنبه آخر ماه و پنج تيرماه قرار گرفته اند.
بهنود شجاعي بهنود اولين فردي است که قرار است روز 22 خردادماه در محوطه زندان اوين اعدام شود. وي که حالا 20ساله است، زماني که 17 سال بيشتر نداشت در يک نزاع خياباني در ونک پارک تهران جواني به نام احسان را به قتل رساند. بهنود که در شعبه 74 دادگاه کيفري استان تهران محاکمه شد در جلسه محاکمه اش گفت؛ من و احسان هيچ کدام عامل اصلي درگيري نبوديم و در واقع دوست من و دوست احسان بودند که با هم درگير شدند. هر کدام از ما به حمايت از دوست مان و در واقع براي پايان دادن به درگيري وارد مهلکه شديم، در آن ميان همه داشتند همديگر را مي زدند، احسان به طرف من حمله کرد و من هم براي اينکه ضربه يي نخورم چاقو را براي دفاع از خودم بيرون آوردم و در کشمکش بين من و احسان چاقو به وي برخورد کرد.به رغم دفاعيات بهنود پسر نوجوان به قصاص محکوم و مراحل قانوني اجراي حکم نيز طي شد تا اينکه يک ماه قبل نام بهنود در ليست اعداميان قرار گرفت. با وجود تلاش هاي انجام گرفته اولياي دم مقتول حاضر نشدند رضايت دهند و عنوان کردند به هيچ وجه از خون پسرشان نمي گذرند. بهنود که روزهاي سختي را در زندان مي گذراند، نامه يي خطاب به مادر احسان نوشت و از او طلب بخشش کرد. در اين نامه بهنود اشاره کرد مادر ندارد و مهر مادري را از مادر احسان طلب مي کند. با اين حال پدر و مادر احسان حاضر نشدند اعلام رضايت کنند تا اينکه با دستور آيت الله هاشمي شاهرودي اجراي حکم قصاص بهنود متوقف شد، با اين وجود باز هم تلاش هاي فردي و گروهي و برگزاري جلسات صلح و سازش در دايره اجراي احکام دادسراي جنايي تهران به نتيجه نرسيد و اولياي دم اعلام کردند حاضر نيستند از قصاص بگذرند.با گذشت يک ماه از توقف اجراي حکم بهنود، دادسراي جنايي تهران يک بار ديگر پرونده اين جوان را روي ميز قرار داد تا نام اين پسر به ليست اعداميان چهارشنبه آخر ماه اضافه شود. محمد فدايي دومين پسر نوجواني که در ليست اعداميان قرار دارد محمد فدايي است. وي متهم است در مقابل باشگاه بيلياردي در رباط کريم در جريان يک نزاع دسته جمعي جواني 21ساله به نام سعيد را به قتل رسانده است. محمد در جلسه محاکمه اش اعلام کرد حين کشمکش سعيد ضرباتي را با چماق به سر او کوبيد و وي در يک حالت دفاعي و براي دفاع از خودش چاقو را بيرون آورد که در پي هجوم عاملان نزاع سعيد روي چاقوي او افتاد و جان باخت. محمد نيز به اعدام محکوم شد و پس از اينکه سن وي به بالاي 18 سال رسيد، سال گذشته در ليست اعداميان قرار گرفت اما در آخرين لحظات مشخص شد دو وکيل محمد قلابي بوده اند و از آنجايي که محاکمه محمد به لحاظ شکلي خلاف نص صريح قانون بود نام وي از فهرست مرگ بيرون آمد. در حالي که حقوقدانان معتقد هستند با توجه به قوانين جاري محمد بايد يک بار ديگر و با داشتن حق وکيل محاکمه شود، نام وي نيز در ليست اعداميان چهارشنبه قرار داده شد. سعيد جزي |
AMNESTY INTERNATIONALMohammad Feda’i is facing imminent execution for a murder committed when he was 17 years old. He was convicted after an unfair trial. Iran is a state party to international treaties including the Convention on the Rights of the Child (CRC), which expressly prohibit the execution of those below the age of 18 at the time of the commission of the offence. According to news reports, he is scheduled to be executed on or around 11 June.
On 21 April 2004, Mohammad Feda’i attended a snooker club with his friends in Robat Karim, a town near the city of Karaj, in Tehran province, when one of his friends was involved in a fight with a group of about 17 young men. According to his testimony, Mohammad Feda’i tried to break up the fight, but a boy named Said started to hit him with a piece of wood. Mohammad Feda’i, who was holding a knife handed to him by one of his friends, then, according to his account, fell over. As Said was about to hit him again, he fatally stabbed Said once in self defence. Said was transferred to hospital, where died three hours later.
The case went before Branch 71 of the Tehran Criminal Court and Mohammad Feda’i was sentenced to qesas (retribution) for the murder of Said on 12 March 2005. Although the five sentencing judges in his case found Mohammad Feda’i guilty, they also acknowledged in their written verdict that the stabbing was an act of self-defence and that he had not been adequately represented at his trial, as his first legal representative was not an accredited lawyer, and two lawyers hired later had only submitted one written defence statement to the court during his trial. Nevertheless, the death sentence against Mohammad Feda’i was upheld by Branch 27 of the Supreme Court, and has been approved by the Head of the Judiciary.
Mohammad Feda’i had been due to be executed on 18 April 2007. However, the execution was stayed on the basis of the inadequate legal representation during his trial. A subsequent request to the Attorney General for a retrial was rejected, and a new execution date was set.
BACKGROUND INFORMATION
As a state party to both the CRC and the International Covenant on Civil and Political Rights (ICCPR), Iran has undertaken not to execute juvenile offenders: those convicted of crimes committed when they were under the age of 18. However, since 1990 Iran has executed at least 28 juvenile offenders, six of them in 2007. At least 85 juvenile offenders are now on death row in Iran. This number may be even higher as at least a further 15 people are believed to have been sentenced to death. – urging the Iranian authorities to review Mohammad Feda’i’s case;
– reminding them that Iran is a state party to both the International Covenant on Civil and Political Rights (ICCPR) and the Convention on the Rights of the Child (CRC), which prohibits the use of the death penalty against those under the age of 18 at the time of offence, and that the execution of Mohammad Feda’i would therefore be a violation of international law.

Saeed Jazee’s death sentence has been approved by the Head of the Judiciary. The family of the victim still have the power to pardon him, but if they choose not to then he will be in imminent danger of execution.
Saeed Jazee, a sculptor, is held in a young offenders centre in Karaj, Tehran Province. He was convicted of the murder of a 22-year-old man, which took place in 2003 when he was 17 years old, and sentenced to qesas (retribution). The Supreme Court rejected his appeal, and his case was sent for final approval to the Head of the Judiciary, Ayatollah Mahmoud Hashemi Shahroudi.
The killing apparently took place after Saeed Jazee had gone to a friend’s sandwich shop, helped himself to a sandwich and started eating it. The 22-year-old man, who had just started working at the shop and did not know Saeed, started arguing with him about the sandwich and attacked him with a kitchen knife. During the scuffle, the knife fell to the floor and Saeed picked it up at the same time as the man charged at him and was wounded in the process. Saeed Jazee and the other employees in the shop tried to help him. During the trial, the shop’s other employees stated that the killing had been accidental. Saeed Jazee has repeatedly stated that the killing was not intentional.
Under Article 206 (b) of Iran’s Criminal Code, murder is classed as premeditated “in cases where the murderer intentionally makes an action which is inherently lethal, even if [the murderer] does not intend to kill the person.”
