نجات نوجوان متهم به‌قتل از مرگ

نوجوانی كه در 16سالگی به اتهام قتل یك جوان بازداشت شده بود، با رضایت اولیای دم از قصاص نجات یافت. او در شرایطی به قصاص محكوم شده و حكم اعدامش از سوی دیوان عالی كشور تایید شده بود كه بنابر نظریه پزشكی قانونی، در هنگام ارتكاب قتل بین 14 تا 16 سال داشته است. به گزارش خبرنگار ما، فروردین‌ماه سال 85 در جریان درگیری در محله نازی‌آباد تهران، جوان 23‌ساله‌ای به‌نام «قاسم» با ضربات چاقو مجروح شد و پس از انتقال به بیمارستان بر اثر شدت خونریزی جان خود را از دست داد. به‌دنبال مرگ این تبعه افغان، «احمد» كه او هم تبعه افغان بوده و به‌گفته شاهدان واقعه ضربات مرگبار چاقو را به قاسم زده بود، بازداشت شد. كارآگاهان اداره ویژه قتل پلیس آگاهی پایتخت در تحقیقات خود پی بردند كه احمد 16ساله هنگام بازی فوتبال در كوچه با قاسم درگیر شده و او را با ضربات چاقو به قتل رسانده است. احمد در بازجویی‌های به‌عمل‌آمده اظهار كرد: روز حادثه در كوچه فوتبال بازی می‌كردم كه قاسم توپ فوتبال من را پاره كرد. قبلا هم با هم دعوا كرده بودیم و او اذیتم می‌كرد. من هم توپ او را پاره كردم. وی ادامه داد: وقتی توپش را پاره كردم به طرف من آمد و با هم درگیر شدیم. من هم او را هل دادم و با چاقویی كه داشتم یك ضربه به سینه چپش زدم. در ادامه رسیدگی به پرونده، وكیل تسخیری متهم با اشاره به اینكه متهم در هنگام ارتكاب جرم زیر 18 سال سن داشته خواستار پیگیری موضوع شد. به این ترتیب پزشكی قانونی با انجام آزمایش‌های مرتبط، اعلام كرد كه متهم در هنگام وقوع جرم بین 14 تا 16 سال سن داشته است. با این وجود قضات شعبه 74 دادگاه كیفری استان تهران چهارم آذرماه سال 86 رای به قصاص متهم دادند. با اعتراض وكیل متهم، پرونده برای تایید به شعبه 27 دیوان عالی كشور فرستاده شد اما قضات دیوان عالی نیز بدون در نظر گرفتن سن متهم و نظریه پزشكی قانونی در این رابطه، رای به اجرای حكم قصاص او دادند. در حالی كه پرونده برای اجرای حكم به اجرای احكام فرستاده شده بود، اولیای دم با حضور در دایره اجرای احكام دادسرای امور جنایی تهران از قصاص احمد گذشت كردند و او را بخشیدند. با رضایت خانواده قاسم، احمد پس از طی مراحل قانونی از زندان آزاد خواهد شد.

Death sentence of another Iranian youth was verified by Iran’s superior court. According to Iran’s ISCANEWS, in August of 2006, 22 year old Mehdi was stabbed by 16 year old Ahmad and died in a Tehran hospital after 6 months. Now that Ahmad’s has reached the age of 18, his case was reviewed by the Iran’s Islamic superior court and he was sentenced to death by hanging.


ISCANEWS reported that In his defense Ahmad told the court: “My father had an accident when I was only 16 years old and I went to visit him because he was bed confined at my step uncle’s home. The water pipe inside the house was broken and my step mother and female cousin had to go to street to wash the dishes (using the faucet outside) and I was watching them from the window. Mehdi and two of his friends who were sitting in the street started make wisecracks at them. My stepmom and cousin came inside the home and  Mehdi and his friends sent a kid to enter our yard and check up on them. I went downstairs and told the boy to leave our home. At this time Mehdi and his friends came and started to beat me up until I fell and hit the dishes that were at the entrance door. While on the ground I saw a kitchen knife that was among the dishes and I picked it up to defend myself “

It is anticipated that Ahmad’s file will soon be sent to Iran’s head of Judiciary, Ayatollah Shahrudi for Estizan (permit to execute)

Background Information:

International law strictly prohibits the use of the death penalty against people convicted of crimes committed when they were under 18. As a state party to the International Covenant on Civil and Political Rights (ICCPR) and the CRC, Iran has undertaken not to execute child offenders. since 1990, the ruling Islamic regime in Iran has executed at least 31 juveniles, including more than 6 in 2007 and one (Javad Shajaee) earlier this week. The number of known persons facing execution in Iran for alleged crimes before the age of 18 has reached 96 according to our latest records. According to the statistics provided by an Iranian police official about 170 children (under 18 at time of alleged crime) can be facing execution in Iran. There has been a substantial surge in processing the children’s file for execution and in the past 3 months SCE has reported 18 imminent executions. Earlier this month 42 European countries condemned Iran for the surge in child executions. Iran has broken the world records in 2007 with at least 297 known executions comparing to 177 in 2006.

As of February 2008 Stop Child Executions Campaign has recorded 101 children facing executions worldwide: 96 in Iran, 2 in Saudi Arabia, 2 in Sudan and 1 in Yemen. In 2007 at least 7 were reported to have been executed : 6 in Iran and 1 in Saudi Arabia. 3 are known to have been saved from execution: 2 in Iran and 1 in Yemen. The first child execution in 2008 was performed by Iran’s regime this week.

RECOMMENDED ACTION:

– Call on the Iranian authorities to immediately halt the executions of Ahmad who was sentenced by the superior court
– Express concern that Ahmad was sentenced to death for a crime committed when he was under 18;
– Calling for the death sentences against Ahmad to be commuted;
– Remind the authorities that Iran is a state party to the International Covenant on Civil and Political Rights and the Convention on the Rights of the Child, which prohibit the use of the death penalty against people convicted of crimes committed when they were under 18, and that the execution of Ahmad would therefore be a violation of international law;
– Urging the authorities to pass legislation to abolish the death penalty for offences committed by anyone under the age of 18, so as to bring Iran’s domestic law into line with its obligations under international law;
– Stating that you acknowledge the right and responsibility of governments to bring to justice those children suspected of criminal offences, but unconditionally opposes their death penalty.

اهنگ مرگ یک نوجوان به صدا درآمد

حکم مرگ پسری که در 16 سالگی آدم کشت امروز در دیوان عالی کشور تایید شد و ضرباهنگ مرگ او به صدا درآمد

به گزارش روز چهارشنبه خبرنگار باشگاه خبرنگار دانشجویی ایران “ایسکانیوز”، در آخرین نشست رسیدگی به این پرونده که 25 مهر 86 در شعبه 74 دادگاه کیفری تهران به ریاست
قاضی«کوه کمره ای»برگزار شد. ابتدا صفر خاکی (ماینده دادستان) به تشریح کیفرخواست پرداخت:«احمد»12 مرداد 1384پسر22 ساله ای به نام «مهدی» را در یک خیابان تهرانپارس با کارد زخمی کرد و او شش ماه بعد در بیمارستان جان باخت.
نماینده دادستان ادامه داد:با توجه به اینکه ضربه مرگ را «احمد» زد از نظر دادسرا گناهکار است و برایش اشد مجازات می خواهم.
سپس وکیل اولیای دم در جایگاه ویژه قرار گرفت و از طرف خانواده داغدار برای«احمد»حکم مرگ خواست.
مجرم 18 ساله وقتی رو به روی پنج قاضی ایستاد جنایت را گردن گرفت:« آن زمان 16 سال بیش ترنداشتم پدرم تصادف کرده و در خانه دایی ناتنی ام بستری بود.برای دیدنش به آنجا رفتم. لوله های خانه او خراب شده بود و نامادری و دختر دایی ام ظرف های غذا را به کوچه بردند. همانجا مشغول شستن بودند که من از بالای پنجره نگاهشان می کردم.
وی ادامه داد: مهدی و دو نفر از دوستانش سر کوچه نشسته بودند و متلک می گفتند. وقتی نامادری و دختر دایی ام به حیاط آمدند دیدم مهدی و دوستانش یک پسر بچه را به آنجا فرستادند تا سرکشی کند.
«احمد»اضافه کرد: از پله ها پایین رفتم و به آن پسر بچه گفتم از حیاط خانه بیرون برود.آنجا بود که مهدی و دوستانش به سراغم آمدند و جلوی در مرا به باد کتک گرفتند.پایم سر خورد و ظرفهایی که جلوی در بود روی زمین ریخت.ناگهان چشمم به کارد آشپزخانه افتاد،آنرا برداشتم و …
تبهکارادامه داد: باور کنید اما من قصد آدمکشی نداشتم.آنان به من حمله کردند و من برای دفاع از خودم دست به کارد بردم.گزارش ایسکانیوز می افزاید،با پایان حرفهای مجرم،قاضی«کوه کمره ای»و چهار مستشار شعبه 74 وارد شور شدند تا با توجه به مدرک ها او را به مرگ محکوم کردند. حکم امروز در شعبه 11 دیوان عالی کشور تایید شد

On a new child killing spree Iran sentences another child to death this week

Yesterday another 17 year old Iranian boy was sentenced to death. Ahmad has been imprisoned since November of 2006 for murder of his cousin (saeed). Both Tehran district attorney and parents of Saeed had demanded the execution of Ahmad.
At the court hearing a street vendor witnessed: ”I was standing with few friends in front a real estate office when we saw Ahmad and Saeed in the alley. First I thought they were joking with each other but suddenly Ahmad (the accused) ran in to the street shouting “I am burning, I am burning”. My friends and I ran to his help and noticed that he was stabbed with a Knife. We put him in the car to take him to hospital but Saeed (the deceased) who by then has sat on his motor cycle (to leave) fell on the ground. When I went there I noticed that he too had been stabbed.”
While on the stand after confessing to the murder, the 17 year old Ahmad said: ” I was sitting in front of (my) home when Saeed and one of his friends showed up. My cousin was not acting normal and I have no doubt that he was drunk. He started swearing at me and without any introduction began stabbing me four times in my arm, head and shoulder. He wanted to kill me and that is why I took a knife that I had in my pocket and stabbed him back once.”
 ”7 months before the incident he (saeed) made a dirty (sexual) suggestion to me and also threatened me, but I don’t know why on that day he came after me. Saeed and I were family members and believe me I had no intention of killing him.” Ahmad added.
After hearing the testimonies, one of the judges of the district 71 of Tehran’s penal court determined that Saeed was not guilty and Ahmad ahmad acted in self defense, however he was sentenced to death by majority vote of the other 3 judges.
Ahmad is the second child offender who is sentenced to death only this week due to Iran’s recent child killing spree.

Although Iran is a signatory to the Article 37 of the United Nations Convention on the Rights of the Child states: “Neither capital punishment nor life imprisonment without possibility of release shall be imposed for offences committed by persons below eighteen years of age “  but Iran also holds the number one record of child executions worldwide. Stop Child Executions Campaign has recorded the names of at least 81 other children facing execution in Iran and many others have already been executed this year or facing imminent executions. 

نوجوان 17 ساله به قصاص محکوم شد

گروه حوادث؛ پسر نوجواني که ادعا مي کند در دفاع از خودش پسرعمويش را به قتل رسانده است روز گذشته محاکمه شد. به گزارش خبرنگار ما آرش سيفي – نماينده دادستان تهران – در ابتداي جلسه محاکمه خطاب به پنج قاضي شعبه 71 دادگاه کيفري استان تهران براي نوجوان 17 ساله که احمد نام دارد و از روز 24 آبان ماه سال گذشته به اتهام قتل پسرعموي خود به نام سعيد در بازداشت به سر مي برد، درخواست مجازات کرد و سپس اولياي دم مقتول نيز قصاص عامل اين جنايت را که در کهريزک به وقوع پيوست خواستار شدند. در ادامه جلسه دادگاه يک فروشنده دوره گرد به نام علي در جايگاه قرار گرفت و به توصيف مشاهدات خود پرداخت. وي گفت؛ من و چند نفر از دوستانم جلوي يک بنگاه مسکن ايستاده بوديم که «احمد» و «سعيد» را سر کوچه ديديم. اول فکر کردم با هم شوخي مي کنند اما يکباره احمد به سمت خيابان دويد و فرياد زد «سوختم سوختم». من و دوستانم هراسان به کمکش رفتيم و ديديم چاقو خورده است. او را سوار ماشين کرديم تا به بيمارستان ببريم اما سعيد که آن موقع روي موتور نشسته بود ناگهان به زمين افتاد. وقتي بالاي سرش رفتم، فهميدم او هم چاقو خورده است.در ادامه جلسه محاکمه نوجوان 17 ساله با پذيرفتن اتهام قتل به دفاع از خود پرداخت و گفت؛ جلوي در خانه نشسته بودم که «سعيد» با يکي از دوستانش آمدند. پسرعمويم حال طبيعي نداشت و شک ندارم مست بود. او به من فحاشي کرد و بي مقدمه با چاقو چهار ضربه به دست، سر و کتفم زد. او مي خواست مرا بکشد به همين خاطر چاقويي را که هميشه همراه داشتم از جيبم بيرون کشيدم و يک ضربه به وي زدم. «احمد» در ادامه درباره علت اختلافش با سعيد گفت؛ 7 ماه قبل از حادثه او به من پيشنهاد کثيفي داد و مرا تهديد نيز کرد اما نمي دانم آن روز براي چه سراغم آمد. من و «سعيد» فاميل بوديم و باور کنيد قصد کشتن او را نداشتم. با پايان اظهارات مجرم 17 ساله رئيس و چهار مستشار شعبه 71 دادگاه کيفري براي صدور راي وارد شور شدند. قضات شعبه 71 دادگاه کيفري استان تهران پس از انجام شور، پسري را که با ادعاي دفاع از خود پسرعمويش را کشته بود به قصاص محکوم کردند. 

يکي از قضات عمل متهم به قتل را دفاع مشروع تشخيص داد اما در نهايت با توجه به راي اکثريت قضات، متهم اين پرونده به قصاص نفس محکوم شد.
