Delara’s message


From a letter by Delara Darabi to those attending the exhibition of her paintings:

“…. I know that my years of struggle for attaining my rights and for my innocence to be heard is not being effective …An imprisoned man once said: “My only claims are my calls to God from my small prison, and my answers to God in the vast field of freedom within these four walls.” .   It is not important where we are …God’s love is always with us …and his promise of truth……Pray for all Delara’s in the faraway lands.”

From a letter by Delara Darabi one year ago to Nazanin Afshin-Jam president and co-founder of the Stop Child Executions:

“….. I don’t know if I will meet you my dear ones or we must leave the meeting to the unseen world. Anyway, Delara is not alone, Delara’s are trapped in prisons and in need of God’s help and in need of defenders of human right and humanity!!!

I hope that you defend humanity and always be successful. The one who defends humanity and knowledge , is not a human but a true knower of God and knower of self. A reference, a gauge and a motive for life…and that is how you are …Nazanin (precious) of all ages.

You and I and all of us, human beings of the world came here …but after a while we forgot everything… We live with different feelings, with perplexity and amazements and we still do not understand why?

I cry a lot, just like the spring clouds! with large droplets…have you ever seen it?! ……I have never cried for being imprisoned, because my thoughts and my heart is free and is with you….Say hello to my true loving friends , because every night during my prayer I pray for all the people of this large and vast house.”

IRAN      Delara Darabi (f), aged 22, juvenile offender

Juvenile offender Delara Darabi was granted a two month stay of execution by the Head of the Judiciary on 19 April, the day before she was due to be executed.

Delara Darabi’s lawyer, Abdolsamad Khorramshahi, has confirmed that her execution has been postponed for two months after the family of the victim refused to attend the execution. They are however still demanding that she be executed. According to Article 7 of Iran’s Code of Procedure on executions, the family of the victim or their lawyer are required to be present for the implementation of the sentence.

Delara Darabi remains at risk of being executed unless the family of the victim agrees on compensation.

BACKGROUND INFORMATION

Iran has executed at least forty two juvenile offenders since 1990, eight of them in 2008 and one on 21 January 2009.

The execution of juvenile offenders is prohibited under international law, as stated in Article 6(5) of the International Covenant on Civil and Political Rights (ICCPR) and the Convention on the Rights of the Child (CRC), to which Iran is a state party, and so has undertaken not to execute anyone for crimes committed when they were under 18.

In Iran a person convicted of murder has no right to seek pardon or commutation from the state, in violation of Article 6(4) of the ICCPR. The family of a murder victim have the right either to insist on execution, or to pardon the killer and receive financial compensation (diyeh).

RECOMMENDED ACTION: Please send appeals to arrive as quickly as possible, in Persian, Arabic, English or your own language:

– welcoming the stay of execution for Delara Darabi;

– calling on the authorities to commute her death sentence, as she is facing execution for a crime committed when he was under 18;

– acknowledging that governments have a right and responsibility to bring to justice those suspected of criminal offences in proceedings that meet international standards for fair trial and the Convention of the Rights of the Child, and pointing out that no one should be executed for crimes committed when under 18;

– calling on the authorities to pass, as a matter of urgency, legislation abolishing the death penalty for all offences committed by those under 18, in accordance with Iran’s obligations as a state party to the International Covenant on Civil and Political Rights and the Convention on the Rights of the Child.

According to Committee of Human Rights Reporters of Iran, Delara Darabi’s attorney, Abdolsamad Khoramshahi has confirmed that “Due to refusal of the victim’s family to attend the execution by hanging and because the laws (of Islamic Republic of Iran) requires that the verdict can only be excercised in the presence of the family, for now the execution has been postponed. However the victim family have not changed their demand for execution”

It has been a long, emotional and exhausting weekend for SCE volunteers, supporters and so many of you around the world but Delara gets to live another day thanks to the efforts of her family, her attorney Mr. Khoramshahi , and many politicians, human rights organizations and activists and so many caring people like you in Iran and around the world…..

We all now deserve a break as tomorrow is another day to continue the struggle to end the imminent execution order of Delara Darabi by the regime in Iran and until the UN Conventions on the Rights of the Child are observed by all governments.

URGENT: Delara to be executed- No Pardon!

  • In an open letter, the family of the victim blamed Delara Darabi for the murder of their mother and asked for the execution verdict of Delara to be implemented.

    In their letter they blamed their decision on Delara, her family, lawyer, media and human rights activists for over-sensitization, misrepresentation and not confessing to Delara’s guilt and stated that the decision and the ruling of the Islamic Judges were based on just Sharia laws of the Islamic Republic of Iran and must be implemented.     Stop Child Executions has always strongly denounced all murders of victims and has shown utmost sympathy for the losses of the families. In the case of Delara Darabi SCE has also continually insisted on the following: 

    1- Iran is a state party to the International Covenant on Civil and Political Rights (ICCPR) and the Convention on the Rights of the Child (CRC), which prohibit the use of the death penalty against people convicted of crimes committed when they were under 18. Delara Darabi was 17 at the time of the alleged murder.

    2- Reenactment of the murder scene as the murder seem to have been by a rights handed strong person while Delara Darabi is left handed. 

    3- A fair trail according to internationally agreed judicial standards.

    We ask the head of Iran’s judiciary Ayatollah Shahrudi to immediately halt the order of execution of Delara Darabi and order a retrial.

    We also ask United Nations Human Rights Commission and other country leaders to immediately contact Ayatollah Khamenei, Iran’s Supreme Leader and Ayatollah Shahrudi, head of Iran’s Judiciary and other high officials of the Islamic Republic and strongly demand an immediate stay of execution.

    We also ask the major international media to broadcast the news of imminent and unjust execution of Delara Darabi.

Once such human rights news comes out, it takes a day or two until mainstream media covers it. It also very much depends on the degree of the public and official attention to the matter, therefore your reactions makes a difference. Yesterday Amnesty International  and Agence France-Presse (AFP)  both reported the pending execution and some other international news agencies and websites in Europe and Asia are also reporting it. Q. What is the latest news from Iran?
 
Delara’s attorney and family along with many ordinary people and human rights activists, artists and celebrities are trying to obtain the pardon of the the family of the victim. Due to international pressure, the government of Iran has pressured Delara’s father who is desperately trying to save Delara, to publicly but indirectly in a letter denounce the coverage of Delara’s situation and the SCE documentary that they participated in 3 years ago which has been broadcasted to Iran from in the Iranian opposition Satellite Televisions. However based on the history of prior harrasments of Delara and her family by officials of Islamic Republic which resulted in 2 years of silence by the family we know that Delara’s family is under pressure from the officials in Iran to make such desperate remarks.  In fact the attempt of officials of Islamic republic to silence Darabi family and Delara was an attempt to try to execute Delara with least attention in Iran and around the world and to try to shift the blame for the pending execution of  Darabi’s family’s on others. Delara has been a symbol of the struggle to Stop Child Executions in Iran and her picture is on the top of websites of the Stop Child Executions and her name on top of the SCE petition. Meanwhile Mr. Khoramshahi Delara’s attorney is also making his last efforts to obtain family’s pardon and also obtain an stay of the execution and a retrial to prove that Delara could not have been the cause of the alleged murder as she was a young petite and fragile left handed sensitive girl, a poet and a painter while her adult boyfriend who was only sentenced to 10 years imprisonment was right handed. Hossein is due to be released in 4 years. It is said that Hossein has contacts in the judiciary of city of Rasht. The demands to create the re-enactment of the crime scene has been denied for the past 6 years. Delara’s attorney Abdolsamad Khoramshahi is also the attorney for Iranian-American Journalist Roxanna Saberi who was sentenced yesterday in a one day closed court session to 8 years imprisonment under the accusation of spying for United States government.
 
Q. What has Stop Child Executions done since the news of the pending executions came out on Thursday?

Nazanin Afshin-Jam has directly contacted the United Nations Human Rights commission, Parliament members and officials in Canada and other countries and other human rights activists. Through our network of our volunteers we have distributed the news and action calls to our large internet networks (see below). Attend Demonstration for Delara

Amnesty International members will demonstrate outside the Iranian embassy at 9am on Monday (20 April) against the scheduled execution of a young women sentenced to death for a crime committed when she was under 18 years old. Reports in the Iranian media says that she could be executed on Monday (some reports even state that the execution could be as soon as Saturday).

Delara Darabi, now aged 22, was sentenced to death in 2005. In 2003, together with her 19-year-old boyfriend, Amir, she went to a woman’s house where Amir reportedly killed the woman. But Delara initially confessed to the murder, saying that Amir asked her to confess to protect him from execution – as she was under 18, they believed that she could not be sentenced to death.

Since then Delara has retracted her confession but she was sentenced to death all the same. She has been languishing in prison ever since, with some reports that she has suffered from ill-treatment.

Amnesty activists around the world are urgently campaigning to stop her execution. The organisation is urging people to take action online by emailing the Iranian authorities. More details at: www.amnesty.org.uk/delara.

Iran has executed at least 42 child offenders since 1990, eight of them in 2008 and one on 21 January 2009. The execution of juvenile offenders is prohibited under international law, as stated in Article 6(5) of the International Covenant on Civil and Political Rights (ICCPR) and the Convention on the Rights of the Child (CRC), to which Iran is a state party.

The young artist Delara Darabi who has spent the last 6 years in Rasht prison in Iran for the alleged murder of a relative, is scheduled to be executed in THREE days from now.  


It was reported that her lawyer Abdolsamad Khoramshahi had been given official notice of her execution date. He is convinced that Delara is innocent and only hopes that the family of the victim will give pardon by accepting “diyeh”  (blood money) as retribution.


Stop Child Executions has reported the urgent news to the United Nations High Commission on Human Rights, Members of Parliament worldwide and other human rights groups and individuals. Stop Child Executions is hoping there is enough pressure on the the head of Judiciary in Iran to grant a new trial whereby Khoramshahi will be able to present the new evidence he has obtained which would prove her innoncence. SCE has also been working to establish contact with the family of the victim to see if there are any other avenues to save Delara’s life. URGENT, DELARA IS AT GREAT RISK OF EXECUTION

What will be Delara’s fate?


 

 

Delara Darabi, the young artist who has been  on death row for the last 5 years in Rasht prison may not have much longer to live. According to her lawyer Abdolsamad Khoramshahi who was recently interviewed by Rooz online, said that soon after the Persian New Year, he had a phone conversation with Delara who relayed to him that there were rumours in prison that she was going to soon be executed soon.

Mr. Khoramshahi said that his client has reason to be worried because her file has gone beyond  any kind of legal recourse and that the only option is for the family of the victim pardon her. He said that one of the children of the victim has neither approved nor disapproved her execution.  Because the Judiciary has already approved her execution, once the family of the victim also  approve , Delara’s execution will be carried out.

Mr. Khoramshahi explained in the interview that  out of deep love for the man that committed the crime, Delara took the blame in the first trial and had confessed to the murder of her father’s cousin. He said that she even went so far as justifying that she was capable of such a crime because she was an athlete and  was strong in Karate.

Later, when she understood that juveniles still face the death penalty for such crimes, she retracted her statement.  By then it was too late and the court did not accept the retraction.  Later, Mr. Khoramshahi had noticed that his client was left handed and the autopsy of the victim had revealed that the stab wounds were committed by a right handed person.

Khoramshahi said that the Judge overlooking the case said that if it was proven that Delara was left handed, the direction of the file would change course. However, even with the evidence required to prove this  fact and further evidence from the Ministry of Education that Delara had never partaken in sports teams or Karate, Delara was not absolved of her alleged crime.

Branch 107 (juvenile court) confirmed her execution in her second trial and yet again in Branch 33 of the Supreme Court. Khoramshahi said that at this stage it is too late to try and repeat the same evidence over and over again. He said that they have gone beyond what can be done legally and that despite his many complaints regarding Delara’s file and new evidence, he has not had any responses come back; nor has there been any efforts from the courts to discover the reality behind her case.

He said “She is on the verge of execution and no legal institute can save her, unless the victim will forgive her”. He emphasized the fact that a lawyer’s responsibility is to defend the case in a “legal” court, but that he has to go beyond his duty. He said he is confident in his client’s innocence and is pleading with the family of the victim to forgive her execution.

He said: “She has spent her whole life around art and painting and the biggest mistake of her life was falling in love with a boy, which has lead to this outcome. Has she not suffered enough having spent the best days of her youth behind bars and experienced the worse physical and emotional pain?”

After three years in prison, Delara’s art was exhibited in Golestan Gallery in Tehran through the help of a prominent journalist and activist Asieh Amini. The paintings were the result of the loneliness she suffered in prison. It brought many people to the Golestan gallery.  The exhibition drew a large crowd; however the fame of this artist, who grew up her whole life surrounded by paintbrushes, could not save her.
